Even when a Will is completed prior to someone passing away, issues can arise once the estate is being distributed.
It is a difficult time when a loved one passes away and hopefully everything runs smoothly when it comes time to the estate. Sometimes, however, it does not run as smoothly as you hope.
Some concerns you can encounter include:
- Questioning the validity of the Will. You may be worried, for example, that someone drafted a Will under pressure from a family member or friend, suspect the Will presented is a forgery or just not the latest one.
- Concerns over the conduct of the Estate Trustee (Executor). Examples of this are disagreements arising between the Executor and the beneficiaries about how the Executor is handling the estate. You may be concerned that the Executor is charging too much or not following the wishes as they were set out in the Will.
- Legal claims can also be launched against the deceased’s estate. This can happen when creditors are owed money and are now looking for payment from the estate or a dependant child was left out of the Will among others.
These are just a few of the common issues that can arise during the distribution of an estate.
